EB-2 NIW Self-Petition Guide

Substantial Merit and National Importance

Your proposed endeavor must have both substantial merit (in business, entrepreneurship, science, technology, culture, health, or education) and national importance — meaning its impact goes beyond your immediate employer or local area.

  • Research addressing a nationally recognized problem (cancer, energy, climate)
  • Entrepreneurial venture with potential for significant economic impact
  • Work that fills a critical gap in healthcare or STEM education
  • Publications cited by others working in areas of national significance

Well-Positioned to Advance the Endeavor

You must show that you — specifically — are well-positioned to advance this work based on your education, skills, knowledge, record of success, or a detailed plan for the future.

Strong Evidence Examples

  • PhD or advanced degree directly relevant to the field
  • Published peer-reviewed papers (especially high citation counts)
  • Patents, awards, or recognitions
  • Track record of successful prior projects in the same area
  • Letters from experts in the field attesting to your qualifications

Benefit to the US Outweighs Labor Market Protections

USCIS must find it would benefit the US to waive the normal job offer and labor certification requirements. This is where you argue why requiring an employer sponsor would be impractical or harmful given the national importance of your work.

Strong Arguments

  • Your work is inherently self-directed (researcher, entrepreneur, artist)
  • Requiring PERM would delay nationally important work
  • No employer is positioned to sponsor you but your contributions are still needed
  • You have an offer from a US entity but it cannot or will not do PERM
